Operating Under the Influence of Alcohol

Leominster District Court

Client a 42 year old Alexandria, VA man charged with operating under the influence of alcohol after being stopped at a State Police road block in Holden, MA.

Police maintained that the client smelled of alcohol, admitted to drinking, failed all field sobriety tests and failed the breath test with a reading of .13, which is above the legal limit of .08.

Attorney Riddle aggressively pursued the breath test records for the machine and after the Commonwealth was unable to produce the records, the judge excluded the breath test results.  This exclusion of evidence of the defendant’s blood alcohol level substantially weakened the Commonwealth’s case.  The case then proceeded to trial and the Commonwealth was unable to sustain their burden.  The client was found not guilty.
