Assault and Battery with Dangerous Weapon

Fitchburg District Court

Client a 21 year old Leominster, MA man was charged with assault and battery with a dangerous weapon.  The alleged victim in the case claimed that after a dispute with the client that the client struck him in the eye with a stick.  The Commonwealth introduced medical records at trial that showed the alleged victim suffered a fractured eye socket and nose.  The alleged victim positively identified the client as the attacker.

Attorney Riddle offered an alibi witness at trial that testified that the client was asleep in bed with her the whole night, including the time the alleged attack occurred.  During cross-examination Attorney Riddle was further able to destroy the credibility of the complaining witness by using his own statements against him.

After a one day trial the jury found the client not guilty.
