Charged with Assault and Battery

Client a 48 year old Leominster, MA man was charged with assault and battery on his live-in girlfriend.

The alleged victim fled the home and immediately reported to police that client struck her in the face after an argument and damaged a door in the residence.  Police arrested client at the residence after he allegedly admitted striking his girlfriend.

Client adamantly maintained his innocence and Attorney Riddle aggressively pursued the case.  Client and Attorney Riddle developed a theory that the girlfriend had been stealing and abusing client’s prescription medication and fabricated this story to avoid getting caught.

Attorney Riddle negotiated the case extensively with the District Attorney and was able to convince them that a trial in this matter was not going to benefit the client or the girlfriend.  Ultimately the Commonwealth and the Judge agreed to place the client on pre-trial probation for 6 months, without making any plea or admission, pursuant to M.G.L. c.276 s.87 and the probation would terminate upon payment of $125.00 restitution payment for the damaged door.  The client simply agreed to stay out of trouble for 6 months or until the door was paid for and the matter is dismissed.  The client does not waive his right to a trial and makes no admission that he violated any laws
