Charged with Operating a Motor Vehicle After Suspension, Disturbing the Peace, Possession of a Class E Substance and Possession of a Class B Substance.

Client a 22 year old Leominster, MA man was charged with Operating a Motor Vehicle After Suspension, Disturbing the Peace, Possession of a Class E Substance and Possession of a Class B Substance.  Police were called by neighborhood residents who reported client and his girlfriend arguing loudly in the street at approximately 1:00am.  Police arrived and observed client and his girlfriend yelling loudly at each other and not following police commands.

Police immediately arrested client for disturbing the peace.  Police further alleged that they had earlier observed client operating his motor vehicle away from a local bar.  Police ran a license check and discovered that he had a suspended license.  As a result police then charged him with operating after suspension.  While checking on an intoxicated passenger in client’s vehicle, which was parked nearby, police found some cocaine and percosets in client’s vehicle.  Client was then charged with the drug offenses.

Attorney Riddle conducted lengthy negotiations with the district attorney’s office and argued that the police should not charge his client for an alleged driving offense by claiming that they had seen him driving earlier in the night, but never stopped him.  Attorney Riddle further argued that the Commonwealth had no way to prove that the drugs found in the vehicle were the client’s, as there were two other occupants in the vehicle, one of whom was intoxicated and had a history of substance abuse.

The client plead guilty to one count of disturbing the peace and paid a $150 fine and the government agreed to dismiss all other charges.
