Unlawful Police Search in Leominster Drug Charges

Leominster District Court Client a 28 year old man from Templeton, MA was charged with possession of a class B substance. The client had a newborn at home and had been working a lot of overtime at work.  While driving to work early one morning the client fell asleep and struck a tree in his vehicle.  The police arrived and immediately began searching the client’s vehicle.  Police discovered some cocaine in a one hitter located in the center console of the vehicle along with some empty cut corner baggies containing a white residue. Fitchburg District Court Client a 61 year old Fitchburg, MA man was charged with one count of operating under the influence of alcohol 2nd offense (OUI, DUI or DWI) also referred to as drunk driving. Women Charged with Assault and Battery in Leominster – Defense Attorney

Leominster District Court Client a 21 year old woman from Leominster, MA was charged with one count of assault and battery. The client was involved in an argument with the father of her child after he dropped the child off at her house accompanied by his new girlfriend.  The client became upset because she was familiar with the new girlfriend and knew her to have lost custody of her child and to be a drug addict.  The client did not want her child to be exposed to the new girlfriend with good reason. Leominster District Court Client a 24 year old woman from Leominster, MA was charged with one count of assault and battery. The client got into a physical confrontation with her boyfriend after they both had been drinking at a bar.  The boyfriend was also charged with assault and battery on the client.  The client was alleged to have struck her boyfriend over the head with an object causing a big cut and a welt on his head. The client obtained a restraining order against her boyfriend to prevent any further contact with him.  After discussing the case extensively with the client and the boyfriend’s lawyer the parties elected to invoke their 5th Amendment privileges and not testify against one another.  The Commonwealth had no other evidence to proceed at trial other than the testimony of the client and her boyfriend.  After invoking their 5th Amendment privileges the Commonwealth dismissed both

Stow MA OUI DUI DWI Charges – Defense Attorney

Leominster District Court Client a 34 year old man from Stow, MA was charged with operating a motor vehicle while under the influence of alcohol (also referred to as OUI, DUI, and DWI), leaving the scene of property damage, operating a motor vehicle after suspension and open container of alcohol in a motor vehicle. The client was involved in a motor vehicle accident while exiting the highway and struck a state highway sign on the side of the road.  A witness observed the client get out of his car, assess the damage and get back in and drive away.  The police found the client in the parking lot of a business down the street. Police stated that the client was unsteady on his feet, had slurred speech and red bloodshot eyes.  The client admitted to having one drink earlier in the day and the police observed two bottles of alcohol

Charged with three counts of violation of a harassment prevention order

Winchendon District Court Client a 54 year old man from Ashburnham, MA was charged with three counts of violation of a harassment prevention order. The client has been involved in an ongoing dispute with neighbors for several years.  The neighbors, a husband and wife, obtained a harassment prevention order against the client.  Client also has an abuse prevention order against the husband neighbor.  The neighbors each individually filed private applications for criminal complaint against client for alleged violations of the harassment order.  The neighbors then later went to the police to complain about the same conduct upon which they filed the private applications for complaint.  As a result three separate complaints ended up issuing against the client for violation of a harassment prevention order, all of which involved the same alleged conduct. Attorney Riddle filed a motion to dismiss two of the three complaints issued against the client as duplicative.

Worcester drug possession – Criminal Defense Attorney

Leominster District Court Client a 42 year old man from Worcester, MA was charged with shoplifting third offense and possession of a class E substance. The client was authorized to pick up his mother’s medication(oxycodone)from a pharmacy and did so.  After picking up the medication client and a co-defendant were observed to be in the parking lot of the pharmacy and crushing up the medication and snorting it from a straw in their vehicle.  Two employees who allegedly witnessed this conduct called the police. Police approached the vehicle and allegedly observed the client counting his mothers pills and saw in plain view some drug paraphernalia.  Officers pat frisked the client and discovered some items on him they believed to have been shoplifted from the store.  No witness at any time observed client to shoplift any items.  Subsequent to the client being arrested the police returned the medication to the client’s
