Client a 67 year old Leominster, MA man was charged with operating under the influence of alcohol, negligent operation of a motor vehicle, unregistered motor vehicle and failing to stop or yield.

The client was involved in a motor vehicle accident after rear ending a car in traffic in Leominster, MA.  Police arrived on scene and made observations of the client that he appeared befuddled, that his speech was thick tongued and slurred, that he emanated a strong odor of alcohol, that his face was flushed, that his eyes were bloodshot and glassy, and that he unwrapped five pieces of gum and shoved them into his mouth. In response to a question by police about whether he had been drinking the client stated he had “a couple of cocktails”.

The client stated that he did not think that the drinks he had affected his ability to drive.  The officer noted that he had to hold the client up to prevent him from falling over and that he staggered.  The client refused to perform any field sobriety tests and refused the breathalyzer test.

Prior to trial the client tendered a plea to negligent operation of a motor vehicle, which was continued without a finding for six months with unsupervised probation.  During a jury waived trial Attorney Riddle argued that the client was shaken up from just being in an accident and only had two drinks earlier in the day and was not under the influence.

Client was found not guilty on the remaining criminal charges and Attorney Riddle was able to get the client’s driver’s license restored immediately.
