Charged with Trafficking Cocaine

Client a 24 year old Fitchburg, MA man was charged with trafficking in cocaine 28-100 grams.  Client was arrested after a warrantless motor vehicle stop based on an alleged tip from a confidential informant (CI) revealed he possessed over 60 grams of cocaine in his pants pocket.  A co-defendant, the driver of the motor vehicle had over $1,700.00 in cash in his pocket, the trunk of the vehicle contained alleged cutting agents and baggies.  The police also seized two cell phones from the defendants, which they proceeded to answer and allegedly listened to multiple callers requesting to purchase cocaine.  Client faced a minimum mandatory sentence of 5 years in state prison.

Attorney Riddle doggedly pursued the case for over 2 years filing multiple discovery motions, motions to suppress and motions to reconsider.  Finally after a motion for discovery was allowed in the case the defendant’s received a critical piece of information, which cast doubt on the credibility of the detective that testified in the earlier motion to suppress.  Based upon the new evidence the Court granted an evidentiary hearing to reconsider the earlier denial of the motion to suppress.  After a thorough cross-examination by Attorney Riddle the Court made a finding of fact that the detective was not credible and allowed Attorney Riddle’s motion to suppress.

All evidence or “fruits” of the illegal stop of the client were suppressed and the Commonwealth had no evidence left to introduce at a trial in the case and the indictment was dismissed.
