Westborough District Court
Client a 35 year old man from Puerto Rico was charged with Trafficking in Cocaine 28-100 grams, Conspiracy to Violate the Drug Laws and Possession of Class D.
The client was a passenger in a motor vehicle, along with two other co-defendants who were similarly charged. State Police stopped the motor vehicle due to a broken tail light and observed a bag of marijuana in plain view. After some questioning, the operator consented to a search of the motor vehicle. State Police recovered $825.00 from the driver, $4,403.00 from my client, and $2,460.00 from the third passenger. Police recovered a small amount of marijuana from my client as well as approximately 40 grams of cocaine from the trunk of the vehicle.
Attorney Riddle engaged in extensive negotiations with the Commonwealth in an effort to keep the case in District Court. As a direct result of those negotiations the District Attorney’s office agreed to keep the matter in District Court and amend the Trafficking in Cocaine charge, which carried a minimum mandatory state prison sentence of 5 years to Possession with Intent to Distribute, which carries no minimum mandatory.
Attorney Riddle filed a Motion to Suppress the search of his client and the motor vehicle. On the day of the Motion the District Attorney and the Judge agreed to a sentence of seven months in the house of correction on the possession with intent to distribute charge and to dismiss the conspiracy and possession of class D charges. The client was given credit for seven months time he had served while awaiting trial and was discharged.
