Client a 24 year old woman from Leominster, MA was charged with one count of assault and battery.
The client got into a physical confrontation with her boyfriend after they both had been drinking at a bar. The boyfriend was also charged with assault and battery on the client. The client was alleged to have struck her boyfriend over the head with an object causing a big cut and a welt on his head.
The client obtained a restraining order against her boyfriend to prevent any further contact with him. After discussing the case extensively with the client and the boyfriend’s lawyer the parties elected to invoke their 5th Amendment privileges and not testify against one another. The Commonwealth had no other evidence to proceed at trial other than the testimony of the client and her boyfriend. After invoking their 5th Amendment privileges the Commonwealth dismissed both cases against the parties.
