Client a 42 year old Lunenburg, MA man was charged with Operating Under the Influence of Alcohol (OUI) 6th offense and possession of open container. After receiving a call from an individual local police approached client while allegedly sitting in his motor vehicle in a parking lot, with an open container of alcohol and the keys in the ignition and the motor vehicle running. Police discovered an open six pack of 16 oz. beers and two empty nip bottles in the vehicle. Client allegedly failed all field sobriety tests, had slurred speech and glassy eyes and failed the breathalyzer test with a reading of .10.
The case was tried before a 12 person jury in Middlesex Superior Court for three days. Attorney Riddle persistently and tenaciously pursued the case and presented evidence to refute all elements of the Commonwealth’s case including public way and operation of a motor vehicle. Attorney Riddle even called an expert witness to testify that the .10 reading on the breathalyzer test was not accurate.
Attorney Riddle was also able to establish that the individual who called police was a police officer in town who was the new boyfriend of the mother of client’s child and that he had an axe to grind with client and therefore called his fellow officers on client to investigate him.
The jury deliberated for less than 30 minutes before returning verdicts of not guilty on all counts.
