Threat to Commit a Crime

A 42 year old Lunenburg, MA man was charged with threat to commit a crime.  Police alleged that the client showed up at the home of the mother of his child in an effort to visit with his daughter and after she refused to allow him a visit he threatened to kill the mother.

Defendant offered evidence during the jury trial that after an argument the defendant stated that he was going to call the department of children and families on the mother, but that he never threatened her.  Defendant further established at trial that when police responded to the residence the alleged victim never complained to police that defendant threatened her.  It was not until later when she spoke with her new boyfriend a police officer in that town and he coached her how to seek a restraining order that she first complained that she was threatened.

The jury deliberated for less than an hour before returning a verdict of not guilty.  In an interesting twist after trial the new boyfriend police officer was forced to retire based on evidence he requested a fellow police officer Attorney Riddle summonsed for trial not reveal the nature of his relationship with the alleged victim at trial (which amounted to subornation of perjury).
